I have purchased a flat at Kalyan, Maharashtra. At the time of booking it was told that all the trivial issue would be taken care of however now they are backing out. Some of the issue that I’m facing is listed below please let me know what kind of legal action can be taken. For their safety they have no prints / brouchers etc.
Issues:
1. Irregularity in color shade of Bathroom tiles.
2. No night lamp point in Bedroom
3. No electric point for dining area
4. Electric point placed just beside the shower
5. Broken titles in Bathrooms and living room.

Respected Sir,
I am Bapi Bhagat of 13/A, Kalika Place, Naskarhat, Kolkata – 700039, had paid as an advance Rs. 3,50,000/- for a Flat at 172/5, P.G.Road, Kolkata -700039. Total consideration money was Rs 6,00,000/- and the handover date of that flat was August 2008. But now the owner is saying that he will not give me my flat, he will sell to other party because he has received advance from that party before me. and he will refund my dues with bank interest.
I can provide you details agreement paper when you will ask.
Hence please advise me what shall i do?

If you have an agreement of sale you can sue for specific performance of the contract. You can also try to get an injunction against the owner from re selling the flat to someone else. If you find these steps tedious, you should settle for recovery of money with interest as promised by the owner.
